Wise Guys Vapes was warned for selling e-liquid tobacco products without required premarket authorization from the FDA. The company failed to comply with the Family Smoking Prevention and Tobacco Control Act by distributing nicotine-containing products that were not commercially marketed as of February 15, 2007, and thus classified as "new tobacco products" requiring marketing authorization orders under section 910 of the Federal Food, Drug, and Cosmetic Act. The FDA's inspection determined these products were misbranded and adulterated under applicable tobacco product regulations, including products containing nicotine from any source as defined by legislation that took effect in March 2022.
