Beauty & Spa Concepts, operating as Beenefits, was warned for selling Brazilian Propolis Extract as an unapproved new drug intended to mitigate, prevent, treat, diagnose, or cure COVID-19, violating section 505(a) of the Federal Food, Drug, and Cosmetic Act. The product was also found to be misbranded under section 502 of the FD&C Act and was marketed through the company's website and Instagram social media without FDA approval. The FDA and Federal Trade Commission jointly reviewed the company's online marketing claims during the COVID-19 public health emergency, determining that the introduction or delivery of this product into interstate commerce was prohibited under sections 301(a) and (d) of the FD&C Act.
