Swity d.o.o., a Bosnia-Herzegovina-based acidified foods processor, violated the Emergency Permit Control regulation (21 CFR Part 108) and the Acidified Foods regulation (21 CFR Part 114) during an FDA inspection in January 2024, rendering their acidified yellow pepper fillet products adulterated. The company failed to adhere to mandatory requirements under 21 CFR 108.25 and 21 CFR 114, and their corrective action responses submitted in February and April 2024 were deemed inadequate by the FDA. As a result, the FDA indicated it may refuse admission of the company's products into the United States under section 801 of the Federal Food Drug and Cosmetic Act.
