Nicecloud LLC d/b/a Nicecloud Vapor, a Toledo, Ohio-based manufacturer of e-liquid tobacco products, was cited for failing to comply with Federal Food, Drug, and Cosmetic Act requirements governing tobacco products containing nicotine from any source. The company manufactures and distributes e-liquid products without having obtained the required premarket authorization orders for "new tobacco products" as mandated under section 910 of the FD&C Act. This violation applied to products subject to FDA jurisdiction under the Center for Tobacco Products, particularly following the 2022 expansion of FDA authority to include all nicotine-containing products, not just those derived from tobacco.
