KMG-IMPORTS, LLC was cited for selling and distributing electronic nicotine delivery system (ENDS) products without required premarket authorization. The company failed to comply with FDA regulations under the Federal Food, Drug, and Cosmetic Act, which mandate that "new tobacco products"—including ENDS products containing nicotine from any source—obtain marketing authorization orders before being legally sold in the United States. The FDA's jurisdiction over these products was expanded in March 2022 to include all products containing nicotine regardless of source, not just tobacco-derived nicotine, making KMG-IMPORTS' distribution of unauthorized ENDS products a violation of federal tobacco product requirements.
