The company's nicotine-containing e-liquid products fell under FDA jurisdiction as tobacco products under the expanded definition that includes nicotine from any source (effective as of March 2022), yet lacked the legally mandated premarket authorization orders necessary for new tobacco products to be marketed in the United States. The FDA emphasized that all tobacco products, including e-liquids regardless of nicotine source, must comply with Federal Food, Drug, and Cosmetic Act requirements and their implementing regulations.
