The company's nicotine-containing products fell under FDA jurisdiction as tobacco products—a classification that expanded in March 2022 to include products containing nicotine from any source, not just tobacco-derived nicotine. The products were found to be adulterated and/or misbranded, as they lacked the legally mandated premarket authorization orders necessary for new tobacco products to be legally marketed in the United States.
