Hoosierecig.com was warned for offering electronic nicotine delivery system (ENDS) products for sale without required FDA premarket authorization. The company failed to comply with the Family Smoking Prevention and Tobacco Control Act by marketing tobacco products containing nicotine—whether derived from tobacco or any other source—without obtaining premarket authorization orders as required for new tobacco products under section 910 of the FD&C Act. The FDA determined that these ENDS products were subject to FDA jurisdiction and were not in compliance with applicable tobacco product regulations.
