My Vapor Den Inc, d/b/a Nu Age Smoke & Vape was warned for selling and distributing e-liquid products containing nicotine without obtaining required premarket authorization orders, as mandated by the Federal Food, Drug, and Cosmetic Act for "new tobacco products." The company failed to comply with FDA regulations governing tobacco products, which now include any products containing nicotine from any source following the 2022 legislative expansion of FDA's jurisdiction. The products were determined to be adulterated and/or misbranded under the FD&C Act and its implementing regulations.
