Alohma, LLC, d/b/a Kure CBD & Vape was warned that its e-liquid tobacco products containing nicotine from any source are subject to FDA jurisdiction and must comply with the Federal Food, Drug, and Cosmetic Act. The company failed to obtain premarket authorization orders required for "new tobacco products" not commercially marketed in the United States as of February 15, 2007, or for modified tobacco products marketed after that date. Under the Consolidated Appropriations Act of 2022, FDA's tobacco jurisdiction expanded to include all nicotine-containing products regardless of source, making the company's e-liquid products subject to FDA oversight and applicable compliance requirements.
