Ecig Charleston LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization orders, in violation of the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's products, which contain nicotine from tobacco or other sources, were not in compliance with the Federal Food, Drug, and Cosmetic Act and its implementing regulations, as "new tobacco products" must obtain marketing authorization before being legally sold in the United States. The inspection review found that the company had failed to secure the necessary premarket approval required under section 910 of the FD&C Act for products not commercially marketed before February 15, 2007.
