Nu Distributions, LLC d/b/a Vapeszn was warned for offering electronic nicotine delivery system (ENDS) products for sale on its website without required premarket authorization from the FDA. The company failed to comply with the Federal Food, Drug, and Cosmetic Act requirements applicable to tobacco products containing nicotine from any source, which fall under FDA jurisdiction following the March 2022 legislative expansion of tobacco product definitions. The FDA identified that these ENDS products were being marketed without the legally required premarket authorization order needed for new tobacco products to be sold in the United States.
