M N T LLC d/b/a ZMARKSTHESPOT was warned for offering electronic nicotine delivery system (ENDS) products for sale on their website without required premarket authorization. The FDA determined that these products qualify as tobacco products under federal law because they contain nicotine from any source, and therefore must comply with the Family Smoking Prevention and Tobacco Control Act and FDA regulations. The company failed to obtain premarket approval orders required for "new tobacco products" not commercially marketed in the United States before February 15, 2007.
