Vapors Inc d/b/a Vapors of Alabama of Jasper manufactured and distributed e-liquid tobacco products without required premarket authorization, violating the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The company's e-liquid products, which are regulated as tobacco products under FDA jurisdiction since the August 2016 deeming rule, failed to comply with the requirement that new tobacco products obtain FDA approval before commercial distribution in the United States. The FDA determined the products were adulterated and misbranded under applicable tobacco product regulations.
