Target Corporation failed to remove ByHeart Whole Nutrition Infant Formula from store shelves following FDA/CDC notification of a multistate infant botulism outbreak linked to the product, which contained Clostridium botulinum and was deemed adulterated under the Federal Food, Drug, and Cosmetic Act. Despite written recall notifications on November 8 and November 11, 2025, FDA inspectors confirmed that recalled formula remained available for purchase across at least multiple Target stores in 20 states well after the recall was initiated and expanded. As of December 10, 2025, the outbreak had resulted in 51 suspected or confirmed cases of infant botulism across 19 states among infants ranging from 16 to 264 days of age. Target's failure to promptly remove the contaminated products from commerce violated its obligation as a consignee to ensure adulterated food was not delivered or offered for delivery.
