The company failed to comply with the Federal Food, Drug, and Cosmetic Act and its implementing regulations, which classify nicotine-containing e-liquids as tobacco products subject to FDA jurisdiction regardless of the nicotine source. The FDA determined that these products required marketing authorization under section 910 of the FD&C Act before being legally sold in the United States.
