Tova Industries, LLC, an acidified foods processor in Kentucky, failed to comply with FDA regulations for emergency permit control and acidified foods processing during an August 2024 inspection of its dry goods and ready-to-eat foods facility. The company did not establish a scheduled process for its Pancake Syrup through a qualified person with expert knowledge in acidification and processing, violating 21 CFR 114.83 and related requirements under 21 CFR Parts 108 and 114. These violations rendered the acidified food products potentially adulterated under section 402(a)(4) of the Food, Drug and Cosmetic Act, as they may have been prepared under insanitary conditions that could lead to contamination or health hazards.
