Apollo Import Export, Inc., a food importer based in North Hollywood, California, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for imported foods including Adjika (Red Pepper Tomato Dip), Hot Eggplant Spread (Caviar), and Imam Bayaldi (Eggplant Spread), in violation of section 805 of the FD&C Act and 21 CFR part 1 subpart L. The company was found in significant non-compliance during a May 2, 2023 inspection following two prior inspections in 2021 and 2022, and failed to respond to the Form FDA 483a observations issued at the conclusion of the most recent inspection. The violations indicated that the importer had not implemented the risk-based verification activities required to ensure imported foods met applicable U.S. food safety standards.
