E-liquid Brands, LLC was warned that its e-liquid products containing nicotine fall under FDA jurisdiction as tobacco products and require premarket authorization to be legally marketed in the United States. The company manufactured and distributed e-liquid products without obtaining the required "new tobacco product" marketing authorization order mandated under Section 910 of the Federal Food, Drug, and Cosmetic Act. The FDA's jurisdiction expanded in March 2022 to include all products containing nicotine from any source, not just tobacco-derived nicotine, and the company's products were found to be in violation of these compliance requirements.
