Candymar Produce Inc, a produce importer, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) as required by section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1 subpart L. During FDA inspections conducted in December 2022 and November 2024, the company was found in significant non-compliance with FSVP requirements designed to verify that imported foods meet applicable U.S. food safety standards. Although the company responded to the warning letter stating it would hire a consultant to develop an FSVP plan starting in January 2025, it failed to provide supporting documentation of corrective actions or any additional FSVP documents to the FDA.
