Vapesatl.com was warned for offering electronic nicotine delivery system (ENDS) products for sale without required premarket authorization, in violation of the Family Smoking Prevention and Tobacco Control Act. The FDA determined that these products, which contain nicotine from any source, qualify as tobacco products subject to FDA jurisdiction and must obtain a marketing authorization order before being legally marketed in the United States. The company failed to comply with section 910(a) of the FD&C Act, which requires new tobacco products to have premarket approval in effect prior to commercial distribution.
