NXNW Vapor Inc. was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization, as mandated by the Family Smoking Prevention and Tobacco Control Act. The company's e-liquid products, which fall under FDA jurisdiction as electronic nicotine delivery systems, were found to be in violation of Federal Food, Drug, and Cosmetic Act requirements applicable to newly deemed tobacco products since August 8, 2016. The warning specifically identified that these products lacked the necessary premarket approval required for "new tobacco products" not commercially marketed in the United States before February 15, 2007.
