Soda Pharm was selling multiple herbal products including teas, extracts, syrups, and balms through their website and social media platforms with claims that they could treat, prevent, or cure COVID-19, violating FDA regulations prohibiting unapproved new drugs. These products violated Section 505(a) of the Federal Food, Drug, and Cosmetic Act by being marketed as drugs without FDA approval and were misbranded under Section 502 of the same Act. The FDA and Federal Trade Commission jointly reviewed the company's online marketing channels on February 7 and March 8, 2022, finding that the products' introduction into interstate commerce was prohibited under the FD&C Act, particularly given the ongoing public health emergency declared for COVID-19.
