A1 Warehouse was warned for selling and distributing electronic nicotine delivery system (ENDS) products without the required premarket authorization orders mandated by the FDA. The company failed to comply with the Federal Food, Drug, and Cosmetic Act requirements for tobacco products, including those containing nicotine from any source following the March 2022 legislative expansion of FDA jurisdiction. As a distributor of ENDS products, A1 Warehouse was required to obtain marketing authorization orders for these "new tobacco products" prior to commercial distribution in the United States.
