Medical Mega was cited for selling triclosan-containing antimicrobial soaps (Ameriderm AmeriWash products in three sizes) as unapproved new drugs in violation of sections 505(a) and 301(d) of the FD&C Act. The products were determined to be drugs based on labeling claims such as "anti-microbial" and "kills bacteria on contact" that indicated intended use to affect body structure or function, yet lacked the required FDA approval for nonprescription drug status.
