MVRB2, LLC, d/b/a Kure CBD & Vape was warned for selling and distributing e-liquid products containing nicotine that are subject to FDA jurisdiction as tobacco products under the Federal Food, Drug, and Cosmetic Act. The company failed to comply with FDA requirements applicable to tobacco products, including the requirement that "new tobacco products" obtain premarket authorization orders before legal marketing in the United States. The FDA's jurisdiction over these products was expanded in March 2022 to include any products containing nicotine from non-tobacco sources, not just tobacco-derived nicotine.
