Smok'n Hot Vapors was warned for selling electronic nicotine delivery system (ENDS) products without required premarket authorization orders, in violation of the Family Smoking Prevention and Tobacco Control Act. The company's vaping products, which contain nicotine from any source, are regulated as tobacco products under FDA jurisdiction and must comply with Federal Food, Drug, and Cosmetic Act requirements, including obtaining marketing authorization orders for new or modified tobacco products. The FDA's inspection determined the company was distributing these products illegally in the United States without the necessary premarket approvals mandated since February 15, 2007.
