Nutrishus Brands marketed RxSugar, RxSugar Organic Liquid Sugar, and RxSugar Organic Pancake Syrup as unapproved new drugs by making disease claims on their website, specifically claiming the ingredient allulose could benefit people with obesity and diabetes, reduce inflammation, lower heart disease risk, and provide anti-obesity and antidiabetic properties. The products violated the Federal Food, Drug, and Cosmetic Act because they were not approved by FDA and lacked scientific evidence demonstrating safety and effectiveness for these therapeutic uses. Additionally, the products were misbranded under the Act because they lacked required drug labeling. The violations were identified during FDA's review of the company's website in May 2021.
