The FDA's Center for Tobacco Products determined that gotpouches.com was offering nicotine pouch products for sale in the United States without required premarket authorization. Under the expanded definition of "tobacco product" that includes nicotine from any source (effective March 15, 2022), these products are subject to FDA jurisdiction and must comply with the Federal Food, Drug, and Cosmetic Act. The company was found to be marketing what the FDA classified as "new tobacco products" lacking the mandatory marketing authorization order required under section 910 of the FD&C Act for legal U.S. distribution.
