Genesis Health International Inc. was cited for misbranding compounded semaglutide and tirzepatide products sold through its website, in violation of the Federal Food, Drug, and Cosmetic Act sections 502(a) and 502(bb). The company falsely represented itself as the compounder of these drug products on product labels and made misleading claims that the compounded drugs contained "the same active ingredient" as FDA-approved medications (Ozempic®, Wegovy®, and Mounjaro®), implying FDA approval or safety evaluation when none had been conducted. These false and misleading statements rendered the compounded drug products misbranded and introduced them into interstate commerce in violation of the FDCA.
