A-Z Tobacco Inc was warned for manufacturing and distributing e-liquid products containing nicotine without obtaining required premarket authorization orders from the FDA. The company failed to comply with Federal Food, Drug, and Cosmetic Act requirements applicable to tobacco products, including those containing nicotine from any source following the 2022 legislative expansion of FDA jurisdiction. The products were subject to FDA oversight under section 901(b) of the FD&C Act and implementing regulations, and as "new tobacco products" not commercially marketed before February 15, 2007, they required premarket authorization before legal distribution in the United States.
