The Center for Tobacco Products determined that vapingby.com was offering electronic nicotine delivery system (ENDS) products for sale in the United States without the required premarket authorization orders mandated by the FD&C Act for new tobacco products. The company failed to comply with FDA jurisdiction over ENDS products containing nicotine from any source, which became subject to FDA regulation following the March 2022 legislative expansion of the tobacco product definition. Under section 910 of the FD&C Act, new tobacco products marketed after February 15, 2007 must obtain marketing authorization before being legally sold in the United States.
