Nature's Highway was selling unapproved CBD products on its website and social media that made claims to mitigate, prevent, treat, diagnose, or cure COVID-19, violating section 505(a) of the Federal Food, Drug, and Cosmetic Act by marketing unapproved new drugs. The products were also misbranded under section 502 of the FD&C Act and their introduction into interstate commerce was prohibited. The FDA and Federal Trade Commission jointly reviewed the company's website in February and March 2022 and determined that these violations occurred during the declared national public health emergency for COVID-19.
