Vape Crusaders Premium E-Liquid LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization orders. The FDA determined that the company's e-liquids, offered for sale through their website, qualified as "new tobacco products" under the Family Smoking Prevention and Tobacco Control Act and therefore required FDA approval before being legally marketed in the United States. The company failed to comply with Section 910 of the Federal Food, Drug, and Cosmetic Act, which mandates premarket authorization for tobacco products not commercially marketed before February 15, 2007.
