The company made disease claims including that Boston C was effective against cancer, could treat degenerative illnesses, and had been used to treat 150,000 patients for various diseases, thereby establishing the products as drugs under the Federal Food, Drug, and Cosmetic Act rather than dietary supplements or foods. These marketing claims violated the Act by promoting the products for use in the cure, mitigation, treatment, or prevention of disease without the required new drug applications or approvals.
