Tuty USA LLC, a food importer based in Texas, failed to establish Foreign Supplier Verification Programs (FSVP) for multiple imported products including wheat snacks, Japanese peanuts, and Blackberry Tartlet Cookies, in violation of section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1 subpart L. During a remote inspection conducted in March-April 2021, the FDA found the company had no FSVP documentation for any of its imported food products, despite a previous warning during a November 2018 inspection. The company's April 2021 response acknowledged it had only just begun implementing the required program and hiring personnel, demonstrating minimal corrective action nearly three years after the initial inspection.
