Tasty Vape Shop was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization from the FDA. The company failed to comply with the Family Smoking Prevention and Tobacco Control Act's requirement that "new tobacco products" undergo FDA review and receive a marketing authorization order before commercial distribution. As e-liquids were deemed tobacco products subject to FDA jurisdiction effective August 8, 2016, the company's continued sale of these products without premarket approval violated the Federal Food, Drug, and Cosmetic Act.
