Vapors Gold LLC was cited for manufacturing and distributing e-liquid tobacco products without the required premarket authorization order mandated under the Family Smoking Prevention and Tobacco Control Act. The company's products, offered for sale on their website, were deemed to violate the Federal Food, Drug, and Cosmetic Act as "new tobacco products" that were not commercially marketed before the February 15, 2007 grandfather date and therefore required FDA premarket approval before legal distribution in the United States. The Center for Tobacco Products determined the e-liquids constituted adulterated and misbranded tobacco products under FDA jurisdiction.
