The FDA determined that the company's e-liquids, sold through their website, met the definition of newly deemed tobacco products subject to FDA jurisdiction under the Federal Food, Drug, and Cosmetic Act, but lacked the legally required marketing authorization to be sold in the United States. The company failed to comply with FDA regulations governing electronic nicotine delivery systems (ENDS) that became effective August 8, 2016.
