Van Howling Enterprise LLC d/b/a Driftwood Vapor, a manufacturer and distributor of e-liquid tobacco products, was cited for failing to obtain premarket authorization for new tobacco products as required under the Family Smoking Prevention and Tobacco Control Act. The company's e-liquid products, which fall under FDA jurisdiction as electronic nicotine delivery systems, were being manufactured and offered for sale without the legally mandated premarket approval that has been required for tobacco products not commercially marketed prior to February 15, 2007. The FDA determined the products were adulterated and misbranded under the Federal Food, Drug, and Cosmetic Act due to the absence of required premarket authorization submissions.
