Flavor Concepts LLC was warned for manufacturing and selling e-liquid tobacco products through its website without the required premarket authorization order mandated by the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquids qualified as newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, and therefore required premarket approval before being legally marketed in the United States. The company failed to obtain the necessary marketing authorization under section 910 of the Federal Food, Drug, and Cosmetic Act before distributing these products to consumers.
