LJ's E-Smokes LLC was warned for manufacturing and distributing e-liquid tobacco products without the required premarket authorization orders mandated under the Family Smoking Prevention and Tobacco Control Act. The FDA determined that e-liquids sold through the company's website were deemed tobacco products subject to FDA regulation as of August 8, 2016, and therefore required marketing authorization before legal sale in the United States. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires "new tobacco products" to obtain premarket authorization orders before being legally marketed.
