Nice Guys Distributing was warned for manufacturing and distributing e-liquid products without obtaining required premarket authorization, as these products are deemed tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires "new tobacco products" to obtain a marketing authorization order before commercial distribution in the United States. The Center for Tobacco Products determined that the e-liquid products were being offered for sale without the necessary FDA approval required since the deeming rule became effective on August 8, 2016.
