Lucky's Vape & Smoke II was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization from the FDA. The company's e-liquid products, classified as newly deemed tobacco products under the Family Smoking Prevention and Tobacco Control Act, were being offered for sale in the United States in violation of section 910 of the Federal Food, Drug, and Cosmetic Act, which requires marketing authorization orders for new tobacco products. The FDA's inspection and review of the company's submissions determined that the products lacked the necessary premarket approval required since the August 8, 2016 deeming rule took effect.
