NEM Advisors LLC / Shop & Save Market, a food importer, failed to establish Foreign Supplier Verification Programs (FSVP) for any of the foods imported from their foreign suppliers, including Bread Mix, Dough Bread Mix, and Farmer's Cheese, in violation of 21 CFR part 1 subpart L and section 805 of the FD&C Act. During a remote inspection conducted January 21-26, 2021 (following a prior inspection in July 2019), FDA investigators found that the company had not implemented any FSVP procedures to verify that their imported foods met applicable U.S. food safety standards. Although the company provided FSVP training certificates in response to the findings, they failed to provide adequate context or documentation demonstrating meaningful compliance with the regulatory requirements.
