JOCOR Enterprises LLC, operating as VOLCANO eCigs, manufactured and sold e-liquid tobacco products without the required premarket authorization orders mandated by the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquid products, which are regulated as tobacco products under FDA jurisdiction, failed to comply with FD&C Act requirements for "new tobacco products" that were not commercially marketed in the United States as of February 15, 2007. The company was operating these products illegally in the U.S. marketplace without obtaining the necessary marketing authorization from the FDA.
