Sadboy LLC was warned for manufacturing and selling e-liquid tobacco products without premarket authorization required under the Family Smoking Prevention and Tobacco Control Act. The FDA determined that e-liquids sold through the company's website (phillyvapesociety.com) are deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, and therefore require a marketing authorization order under section 910 of the FD&C Act before legal distribution in the United States. The company failed to obtain the requisite premarket approval for these "new tobacco products" that did not have commercial marketing status as of February 15, 2007.
