The company's e-liquid products, deemed tobacco products under FDA jurisdiction as of August 8, 2016, failed to comply with Federal Food, Drug, and Cosmetic Act requirements applicable to electronic nicotine delivery systems. The Center for Tobacco Products determined the products were adulterated and/or misbranded due to their unauthorized marketing status.
