Gothic Vapor LLC was warned for manufacturing and distributing e-liquid tobacco products without the required premarket authorization orders mandated by the Family Smoking Prevention and Tobacco Control Act. The FDA's review of the company's website determined that their e-liquid products, as deemed tobacco products effective August 8, 2016, were not in compliance with Federal Food, Drug, and Cosmetic Act requirements for new tobacco products that must obtain marketing authorization before legal U.S. distribution. The company failed to obtain the necessary section 910 premarket approval orders required for tobacco products not commercially marketed in the United States as of February 15, 2007.
