Vapor City Plus, LLC was warned that its e-liquids, sold through its website, are tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act, which took effect August 8, 2016. The company failed to obtain premarket authorization orders required under section 910 of the FD&C Act for "new tobacco products" not commercially marketed in the U.S. before February 15, 2007. The FDA's Center for Tobacco Products determined the e-liquids were being manufactured and offered for sale or distribution without the legally required marketing authorization, rendering them adulterated and/or misbranded in violation of federal tobacco regulations.
